General Terms and Conditions
These general terms and conditions of sale are governed by French law and may be modified at any time without notice.
Purpose:
These General Terms and Conditions of Sale (hereinafter “the GTC”) define the terms and conditions under which any natural or legal person of French or foreign nationality (hereinafter “the Customer”) orders and purchases the Products offered for sale by TRICOTHE Passion.
Acceptance of the general terms and conditions of sale:
When the customer confirms their order on the tricothelyon.fr website, they declare that they accept its content and the general terms and conditions of sale of tricothelyon.fr, which are governed by French law.
Products:
All products presented on our website or in our catalog can be purchased while stocks last.
However, if for technical reasons a product is unavailable, we will inform you as soon as possible by email or post.
None of the photos on the website are contractually binding.
As the items in the store are handmade, they may vary slightly in size from the dimensions indicated.
All our designs are registered with the INPI.
All text and photos published on the tricothelyon.fr website are protected by copyright.
Prices:
All prices displayed on tricothelyon.fr are inclusive of VAT and exclude additional costs (shipping costs, customs duties, insurance, etc.). Prices are expressed in euros based on the rates in effect at the time of ordering.
For sales to French overseas departments and territories and outside the EU, VAT will be automatically removed from the shopping cart after the delivery address has been validated in the order form.
Shipping costs:
Shipping costs are not included in the price of the products. tricothelyon.fr covers part of the shipping costs and charges you a flat fee based on the destination and shipping method.

Customs duties and other local taxes in the recipient's country, if applicable, are entirely the responsibility of the Customer.
Order:
Customers wishing to place an order must first identify themselves.
To do so, they must fill out a form provided online, following the instructions given, indicating their surname, first name (or company name), email address, postal address, delivery address if different, and telephone number.
tricothelyon.fr reserves the right to verify the accuracy of any information entered by the Customer, in particular their identity and address.
tricothelyon.fr informs the Customer that the information they have provided in connection with the order is subject to automated processing of personal data for the purposes of creating customer files and/or detailed invoicing. tricothelyon.fr has declared to the French Data Protection Authority (CNIL) that it carries out automated processing of personal data (declaration receipt no. 759404).
In accordance with the provisions of Article 34 of the French Data Protection Act of January 6, 1978, the Customer has the right to access and rectify said files at tricothelyon.fr.
Once the Customer has chosen the Products they wish to purchase, they confirm their order by reviewing the summary displayed on the screen, selecting their payment method, and clicking on “Confirm my order and pay.”
At this point, the order is registered.
The Customer will be notified of the Acceptance or Refusal of the Order by tricothelyon.fr within a maximum of 48 hours of receipt of the order, by email.
The sales contract between the Customer and tricothelyon.fr will only be concluded once the Customer has confirmed their order and tricothelyon.fr has confirmed its acceptance of the order to the Customer.
Payment methods:
- By credit card SECURE PAYMENT - VISA - EUROCARD - MASTERCARD
Our website's payment system is fully secured by MONETICO and CIC. Your credit card details are encrypted on your computer and transmitted in this form to the bank operator, who decrypts them and manages the payment authorizations.
- By check in euros (only for accounts domiciled in France) enclosed with the order, made payable to TRICOTHE Passion, with the order number provided on your order form written on the back of your check.
For orders paid by check, the products are reserved for 14 days. After this period, if your check has not been received, your order will be automatically canceled. The order will only be prepared upon receipt of the order accompanied by the check.
Delivery:
Given that some of our products can be customized, they are made to order.
The delivery time is indicated in the Order Acceptance.
The delivery time is equal to the order processing time plus the delivery time of the postal service. Delivery times are provided for information purposes only and are not guaranteed by TRICOTHE Passion.
Furthermore, TRICOTHE Passion cannot be held liable in the event of a carrier strike.
TRICOTHE Passion entrusts its deliveries in mainland France to La Poste.

Delivery in mainland France, Germany, Belgium, Luxembourg, and the Netherlands: Flat rate of €7.15 for orders up to €99.00 excluding VAT, free for orders over €100.00 excluding VAT
Delivery to Poland, Spain, Italy, Austria, Spain, Ireland, Italy, Portugal, United Kingdom, Switzerland, Denmark: Flat rate of €13.00 for orders up to €199.00 excluding VAT, free for orders over €200.00 excluding VAT
Delivery to the United States and Canada: Flat rate of €33.00 for orders up to €299.00 excluding VAT, free for orders over €300.00 excluding VAT
For deliveries to French overseas departments and territories and all other destinations: Please contact TRICOTHE Passion by email.
You can track your package on the La Poste website by entering the package number that we provide in the shipping confirmation email.
TRICOTHE Passion cannot be held responsible if the recipient is absent when the Products are delivered and/or if the Customer (or the person designated by the Customer) is late in collecting the Products from the carrier or fails to collect them after the carrier has left a delivery notice with the recipient.
Packages returned to TRICOTHE Passion for reasons such as unclaimed packages, incorrect customer address, or the customer not living at the address provided, will be subject to
- either a refund of the cost of the goods, with the shipping costs remaining the responsibility of the customer, or
- reshipment at the customer's expense.
In both cases, if the actual shipping costs calculated based on the Post Office's rates are more than 10% higher than the flat rate, the actual amount will be taken into account and not the flat rate.
For deliveries without a signature, the delivery notification by the Post Office serves as proof of delivery.
Guarantees:
Withrawal period:
The Customer has a period of 14 clear days following delivery of the products to request an exchange or refund for their items from our customer service department at the following address: tricothe.lyon@yahoo.fr
However, this only applies to items returned in their original sealed packaging with all accessories, accompanied by a copy of the order, and after TRICOTHE Passion has acknowledged receipt of the return request.
The return shipping costs are the responsibility of the Customer.
Defective item:
After accepting the return request, TRICOTHE Passion will send the Customer, by EMAIL, the return slip that the Customer must attach to the package in order to return it.
The Item will be exchanged within 15 days of receipt of the Product by TRICOTHE Passion.
Damaged package:
TRICOTHE Passion assumes the risk of loss or damage to the Products throughout the entire transport of the Products and until delivery of the Products to the Customer.
In the event of damage, breakage, or missing items, the Customer must note their reservations in writing on the delivery slip and confirm these reservations to TRICOTHE Passion by registered letter and email no later than 24 hours after delivery.

Force majeure:
TRICOTHE Passion shall only be bound to fulfill its obligations insofar as no event of force majeure prevents it from doing so.
Data confidentiality:
In accordance with the French Data Protection Act of January 6, 1978, all computer data concerning the Customer shall be treated as strictly confidential.
The Customer therefore has the right to access and modify the content.

If the contract is entered into with a co-contractor who is also a trader, the Commercial Court of Lyon shall have sole jurisdiction to hear any disputes and proceedings.
